Domestic Violence

Domestic violence, also known as spousal abuse when occurring during a marriage, is the infliction or threat of physical harm against a past or present intimate partner, including a spouse or former spouse, cohabitant or former cohabitant, or parent of the abuser's child.  It includes physical, sexual, and psychological abuse, as well as a pattern of assaultive, coercive, and controlling behaviors directed at a partner.  When domestic violence causes bodily injury resulting in a traumatic condition, it may be punishable as a felony.

Emergency Protective Orders

If a client has suffered from domestic violence or spousal abuse, the Timothy Peabody Law Firm is always available and can help take immediate and aggressive action by requesting an emergency protective order.  An emergency protective order may be issued by a judicial officer even when a court is not in session, as long as person or child is in immediate and present danger of domestic violence.  To obtain such an order, a law enforcement officer must assert that there is such a danger, based on an allegation of recent abuse or threat of abuse, and that the order is the only way to prevent the violence.

Restraining Orders

In addition to emergency orders, our firm helps clients obtain temporary restraining orders (TROs) from the court that are comprehensive and effectively prevent an abuser from harassing clients and their families.  These orders may prohibit a person from all types of abuse, including everything from telephoning the petitioner and his or her family to stalking, threatening, assaulting, or even coming within a specified distance.  A TRO may be issued that gives possession of the family home and other property to the petitioner, at least temporarily, regardless of who holds the legal title.  In addition, TRO may also give custody of the children to the petitioner until a permanent custody order is issued by a judge.

Sometimes, during a divorce or child custody battle, a spouse or parent may falsely accuse the other spouse or parent of domestic violence in order to gain an advantage and obtain custody of the children, increased support, and/or possession of the family home.  When this occurs, the firm utilizes its over 22 years of experience in the family courts to aggressively argue against a TRO and carefully demonstrate the accuser's lack of proof of abuse.
